Justice Hellen Wasilwa ruled that the NPS is the only mandated institution that has the authority to recruit, train, and assign tasks to police personnel.
She declared the NPSC recruitment notice null and void due to constitutional violations.
Wasilwa emphasised that operational responsibilities were outside the purview of the NPSC’s constitutional mandate and that the Commission’s duty was specifically to handle monitoring and administrative duties.
Additionally, the judge ruled that Legal Notice No. 159 of September 19, 2025, was illegal and issued a permanent injunction prohibiting the NPSC from conducting any recruitment, training or dismissal of officers.
Inspector General Douglas Kanja, the Attorney General Dorcas Oduour, and the National Police Service had joined the case challenging the police recruitment exercise.
