Embattled Comfort Homes Owner Denies Fraud Claims, Threatens to Sue Online Trolls

Real estate company Comfort Homes has defended itself against social media allegations by a client accusing the firm of fraudulently taking her money in a disputed loan arrangement.

Chief Executive Officer Ezekiah Kariuki Mwangi dismissed the claims made by Lucy Muthoni Kamuigua, clarifying that the dispute was already settled in court and that the company acted lawfully in all its dealings.

Speaking exclusively on TUKO.co.ke on Monday, November 3, Mwangi said the client approached Comfort Homes and Together as One, a property and home-financing outlet in 2020 seeking financial help to clear a KSh 2 million loan she had acquired from another lender.

What transpired between Comfort Homes and Lucy Muthoni?

“We agreed to buy off the loan on her behalf, and a repayment agreement was signed,” Mwangi said, producing court documents and payment agreements from the transaction.

According to the CEO, Lucy initially received KSh 1.2 million, followed by another KSh 800,000, using her Ruiru property as collateral.

She later requested an additional KSh 100,000 to facilitate travel abroad for a business venture.

However, the arrangement later turned contentious, leading to several complaints filed with the Kayole Police Station, the Directorate of Criminal Investigations (DCI), and the Director of Public Prosecutions (DPP) all of which, Mwangi claims, failed to overturn the agreement.

In 2023, the Chief Magistrate’s Court in Nairobi ruled in favour of Comfort Homes, directing Lucy Muthoni to pay KSh 3.5 million to the firm in 24 equal monthly instalments of KSh 145,800, effective June 1.

The court further ordered her to appoint a mutually agreed agent to manage and collect rent from Plot No. B124 in Ruiru, with the rent proceeds remitted directly to the loan account until full repayment.

The rent collections were to exclude a 10 percent agency fee and a caretaker’s salary of KSh 12,000 per month.

Comfort Homes sues Lucy Muthoni and her daughter

Lucy was also required to cover any shortfalls from the rent income and was granted limited access to the property until full repayment of the loan.

Comfort Homes has now filed a new case accusing Lucy and her daughter, Jacqueline Wambui Murimu, of contempt of court, alleging they have been posting defamatory content on TikTok and other social media platforms that has damaged the company’s reputation.

The firm is seeking orders to bar the two from making any further defamatory statements until the court-ordered payments are completed.

According to Mwangi, Lucy has so far paid KSh 597,400, leaving an outstanding balance of KSh 2.9 million.

Comfort Homes says it has been in business for 18 years, serving over 30,000 clients and employed more than 700 people across Kenya.

Comfort Homes rewards woman shamed online with an ambassador role

TUKO.co.ke previously reported that a Kenyan woman, Purity Kendi, who was once shamed online, turned her ordeal into a success story after landing a brand ambassador deal with Comfort Homes.

Kendi’s name trended online after videos of her were shared by a man she claimed had been blackmailing her. She later went public to apologise, saying she had been offered KSh 20,000 to record the videos.

The mother, who works as a mama mboga, said the scandal left her broken, but things changed when Comfort Homes offered her a fresh start.

The company appointed her as their new brand ambassador and gifted her a plot of land in Juja worth KSh 600,000.
