A Nairobi magistrate has today issued a temporary injunction after a businessman rushed to court and stopped the wedding of his daughter, which was set to take place tomorrow, Saturday, December 6, at Karen.

Milimani commercial court magistrate Gerhard Gitonga issued the order after Francis Ogallo rushed to court, accusing his ex-wife of allegedly humiliating him and excluding him from his children’s lives.
Through lawyer Danstan Omari, Ogallo told the court that his case was urgent, arguing that he had been married to his ex-wife for 32 years but divorced in 2024.

However, he has accused his former spouse of orchestrating a campaign to exclude and humiliate him.
“The respondent has deliberately taken steps to maliciously exclude, humiliate, and discriminate against me. Her actions violate my constitutional rights as a parent,” he stated in court papers.
Where was Francis Ogallo’s daughter’s wedding venue?
The wedding was set to take place at Suswa Gardens in Karen, but the businessman told the court that his ex-wife had a history of embarrassing him during major family events.
He claimed he had previously been excluded from another daughter’s wedding in 2021.
He argued that the exclusion amounts to emotional abuse under the Protection Against Domestic Violence Act.
“That the said actions by the respondent arise from a history of personal vendetta and defamation against the applicant, including spreading damaging allegations concerning the applicant to her employees, colleagues, and members of her church community, all of which have placed his reputation in disrepute and in the public domain without just cause. During our eldest daughter’s wedding, she orchestrated events intended to publicly demean me. She has now resumed the same conduct,” court papers state.

Ogallo further told the court that he never refused to participate in the ceremony, except that he preferred not to be part of a ceremony presided over by specific clergy due to past conflicts.
“Fearing further humiliation and irreparable violation of his rights under Articles 27, 28, 33 and 45 of the Constitution, the applicant is seeking an immediate injunction barring the wedding from proceeding without his involvement. Unless this court intervenes, the ceremony will proceed and render this entire application nugatory,” Omari, his lawyer, argued.
He also claims that the mother of his children misrepresented his views on the choice of clergy, circulated false allegations about him, and shared his private communication with third parties in a bid to justify his exclusion from his daughter’s wedding.
“That the respondent now resumed similar conduct in respect of the forthcoming wedding, despite the applicant clearly communicating that he would not participate in the wedding should certain religious figures be involved”, court papers continue to state.
Threats and defamation
In his affidavit, he has further accused his ex of reporting him to the Directorate of Criminal Investigations over alleged threats and defamation. He presented a summons dated November 12, 2025, requiring him to appear before the RCI Nairobi Area, which was annexed to the court papers. He denied all those allegations.

The magistrate issued a temporary injunction stopping the wedding and directed that it be resolved through family negotiations or mediation.
“That this is a family dispute that ought to be resolved through family negotiations and/or mediation.That, in the meantime, a temporary order of injunction be and is hereby issued restraining the respondent, her agents, servants, representatives or any other persons acting at her behest from proceeding with, conducting, facilitating or in any other way participating in the planned wedding ceremony of the applicant’s daughter scheduled for Saturday, 6th December, 2025, pending the said inter partes mention for further directions,” the orders read in part.
Gitonga also directed that the order be served upon the OCS at the nearest police station for enforcement, with the court attaching a warning that any disobedience would attract legal consequences.
