An American citizen, Hudeife Muhumed Mire, was arrested in Kajiado and presented at the Milimani Law Courts on Friday, October 31.

Muhumed, who is wanted by the United States District Court for the District of Minnesota in a case dated July 5, 2022, is accused of committing serious criminal offences in the US.
The suspect is alleged to have murdered Samantha Myers on April 22, 2022 by selling her drugs laced with deadly fentanyl, which caused her overdose and death.
After committing the offence, Muhumed fled the State of Minnesota and travelled to Nairobi, Kenya, with the intent to evade prosecution. The prosecution cited this as an extraditable offence under Kenyan law.
However, he was arrested in Kenya on October 29 in the Ongata Rongai area of Kajiado County, following a warrant of arrest issued by the United States District Court for the District of Minnesota.
Muhumed is charged with the following offences under US law.
Third-Degree Murder in violation of Minnesota Statute 609.205(1); he also faces charges of selling, giving, or distributing a controlled substance (Schedule I & II) in violation of Minnesota Statute 609.205(1).
Another charge is Manslaughter in the Second Degree, Culpable Negligence Creating Unreasonable Risk, in violation of Minnesota Statute 609.195(h).
The final charge is a First-Degree Drug Offence involving 100 grams or more of other narcotics within a 90-day period, in violation of Minnesota Statute 152.021.1(4) and Title 18, United States Code, Section 1073.
The offences for which Muhumed is wanted are punishable under the laws of the requesting state and would constitute offences under Kenyan law if committed within Kenya, thus satisfying the dual criminality requirement under Section 4 of Cap. 76.
The prosecution further stated that Kenya is a member of INTERPOL and bound by its Constitution and Rules, which obligate member states to assist in locating and detaining fugitives upon issuance of a valid Red Notice or request from a competent authority.
The prosecution added that the INTERPOL National Central Bureau (NCB) Nairobi received a formal request from INTERPOL Washington and the US Department of Justice for the provisional arrest and detention of the respondent pending extradition proceedings.
The prosecution also noted that, pursuant to Article 2(6) of the Constitution of Kenya (2010), international treaties and conventions ratified by Kenya form part of the law.
Kenya is bound by the United Nations Convention Against Transnational Organised Crime and the International Convention on Mutual Assistance in Criminal Matters.
In conclusion, the prosecution prayed that the Court issue a custodial order for the detention of the respondent at Gigiri Police Station, Nairobi, pending the hearing and determination of the extradition proceedings initiated by the Office of the Director of Public Prosecutions in collaboration with the US authorities.
In his ruling, Chief Magistrate Lucas Onyina granted the prosecution a 21-day custodial order and directed that the accused be detained at Gigiri Police Station pending the hearing. The matter will be mentioned on November 21.
