Can courts challenge Suluhu’s win?
As reported earlier, Samia’s controversial win cannot be challenged by any person.
According to the Tanzanian Constitution of 1977, Article 41, once the Electoral Commission declares a candidate duly elected, the courts have no authority to challenge or investigate the election outcome.
This clause shields presidential results from judicial review, affirming the finality of Suluhu’s victory.
According to the same constitutional provision, the president-elect must be sworn into office within seven days of the declaration, unless prevented by resignation or death.
